Bombay High Court has lifted ban on Maggi noodles imposed by Food Safety and Standard Authority of India (FSSAI) and Food and Drugs Administration (FDA), said Nestle India said on Thursday. However, the company said manufacture and sale of MAGGI noodles is subject to certain conditions. The court has also ordered to conduct fresh test on MAGGI noodles to find whether the product is safe to eat or not.
Bombay High Court gave this ruling on Nestle India's Writ Petition. In the Petition, the company raised issues of interpretation of the Food Safety and Standards Act and the orders passed by the Commissioner of Food Safety Maharashtra and the FSSAI.
MAGGI noodles was banned after the lab tests conducted by state governments showed Nestle product unsafe due to high level lead and MSG.
Earlier on Wednesday, the Indian government had filed class action suit against the company on grounds of unfair trade practices, sale of defective goods and sale of Maggi Oats Noodles to the public without product approval. The government has claimed total sum of Rs 6,399.57 million from Nestle India.
Shares of the company gained Rs 238.9, or 3.86%, to trade at Rs 6,423.60. The total volume of shares traded was 74,333 at the BSE (1.58 p.m., Thursday).
